New Implementation of I-864
Rather than allowing a customary public comment period, USCIS recently announced that it would immediately implement a new version of the I-864 affidavit of support (required in most green card applications). That would have caused denials to applications that were about to be filed or had already been posted. Thankfully, USCIS is now allowing a 30-day grace period before implementing the new version of the form. USCIS just made the following announcement: “USCIS is providing a 30-day grace period during which we will accept the 10/17/24 edition of Form I-864. Beginning Oct. 1, 2026, we will only accept the 08/24/26 edition of Form I-864. USCIS will not process any 10/17/24 edition of Form I-864 postmarked or electronically submitted on or after Oct. 1, 2026.” Here is the link to that announcement: https://www.uscis.gov/i-864
